Court System

"The Congress shall have power ... to constitute tribunals inferior to the Supreme Court." This section charges the Congress with the duty of creating a federal judiciary beyond the Supreme Court. Congress began fulfilling this responsibility by passing the Judiciary Act in 1789


The constitution was remarkably silent on the question of the the court system. While being very specific when it came to Congress and the Presidency it left it fully up to Congress to set up the court system.
